I received a call recently from someone who was in a rear-end collision. They refused medical care at the scene. After a couple of days their pain was bothering them so bad they had someone transport them to the hospital. Luckily it turned out that they did not have serious injuries and were released from the hospital diagnosed with whiplash.
I asked the caller how they were feeling and they said they were fine and would not be getting additional treatment. I then asked how I could help them. They wanted to know if they needed an attorney. In this caller case I did not feel that they needed an attorney. Clearly this person has damages, (hospital, professional service fee, and radiology bill), but the bills are the only damages. The caller did not miss any work, and the property damage or vehicle was totaled and paid.
In the grand scheme of things, this matter will not have a great deal of pain and suffering attached to it. As a result if an attorney gets involved it likely will not get the person involved in the accident enough to pay their medical bills.
In matters where there is limited treatment, it does not necessarily benefit someone to obtain an attorney.
