So what is important is to be clear about what you may or may not be settling. When you are injured you have a claim for 1) property damage, and 2) bodily injury.

A property damage claim is all of the damages related to your damaged your car and any items damaged in your car during the crash. Items such as glasses, cell phones, or any other items included or not with the value of your vehile. Often times the insurance company will send out someone to appraise and determine if the vehicle can be fixed or it is a total loss. If the vehicle can be fixed then they will issue a check to who ever is going to repair the vehicle. If it is a total loss they will pay the fair market vaule of the vehicle taking into consideration the condition and the mileage as well as the make and model. Once the vehicle is declared a total loss or that it can be fixed the insurance company is eager to settle the claim promptly. As such they may be willing to come to you in order to settle this matter.
