Often times when someone is hurt on the job, they are entitled to medical benefits or medical care as it relates to their work related injury. Sometimes their injuries are serious enough for the doctor to take them out of work. Currently under Georgia law, you are not entitled to income benefits unless you are taken out of work for more than seven days. After you have been taken out of work by a doctor for over seven days you are entitle to what is call temporary total disability benefits.
The calculation will depend on how long you have been employed with the employer. If you have worked over thirteen weeks, usually to calculate your income benefits you take the thirteen weeks prior to the on the job injury and average the payments. After you average the payments you then take two thirds of the average with no more than $525.00 per week. That will be what is referred to as your comp rate.
