Atlanta Personal Injury Attorney – Do you have to serve the person who hits you when you are involved in an accident or do you just serve the insurance company?

This is a commonly misunderstood topic. If you are suing someone who has hit you in a car accident, you are suing the driver not the insurance company. The insurance company (because of a contract with the at-fault driver) will represent the at-fault driver, but you cannot just serve the insurance company.

This helps make service of the lawsuit a little more challenging and a reason why our office will not take any case that is within six months of the statute of limitations or deadline.
