This is a tricky question. The reality is the employer/insurer do not have to settle your claim. Typically the reasons insurance companies want to settle workers compensation claims are you are getting weekly checks or need a surgery that is going to cost them a lot of money and may lead to further unpredictable medical expenses . They do not like to keep paying people, so at that point, they may see if you want to settle. Another reason they like to try to settle your case would be if you had a surgical recommendation. Typically any reason to save them money on the expectation of where your claim is going. In other words they are interested in settling with people if they think by doing so they will save themselves money down the line. Realize even though this is personal to you, it is all business for them.
