Typically the employer will want to request a urine test immediately after the work accident. However, we have seen where the employer requests the test shortly after the injury.
If this is test is positive for drugs the employer must prove that the cause of the injury was due to intoxication of the drugs that you tested positive for in the test.
When drug test come out negative then there are no issues. Also, you must look closely at the drug you tested positive for and verify it is not indicative of any drugs you were provided at the clinic and or hospital you attended shortly after being injured.
