Atlanta Workers’ Compensation Attorney – Think Your Adjuster Is Not Talking To Your Doctor on your Georgia WC Claim?

I usually get a shocked reaction when I tell my clients the adjusters are talking with their doctors about their claim, attempting to push them back to work whether they are ready or not.  See this article from ClaimsJournal.com, and you will see what the claims adjuster is attempting to do with your workers’ compensation claim to make their business more profitable.  Still think they have your best interest in doing the right thing?

Most of the time the injured worker is returned to work and is still having problems and is still in pain, this is where the business end of the insurance gets in the way of the best interest of the worker, sometimes causing greater injury forcing to the worker to do what physically they can not.

How can you as an injured worker stop the insurance company from speaking with your doctors about your medical care?  The short answer is you can’t.

So what is the answer?  Well there are rules that the employer/insurer must follow in order to have control over you medical care, if they do not follow the rules, and you are able to get to a medical provider who will listen to you and treat your injuries and not a doctor who hardly speaks with you already knows they are going to return you to work before they even see you based upon the information they have received from an adjuster, then you have a fighting chance to get the care you need to return you back to work if you are not too seriously injured.

When I speak with potential clients on the phone, most of them tell me, I do not want to “get one up on the system”, I am just trying to be treated fairly and get the care I need to return to work to support my family.  My response is “don’t worry, you will not get one up on workers’ compensation”.  Regardless of this fact, workers’ compensation offers in some cases the only way to pay for medical care to return an injured worker to some form of employment moving forward.  Often times it is the only coverage they have before paying out of pocket and the likelihood of bankruptcy.
