Can I Contact The Insurance Company After I Have Filed a Lawsuit?

If I have filed a lawsuit in an auto accident can I contact the insurance company?  Generally speaking, no.  Just as the insurance company is not supposed to contact you if you are represented by legal counsel, you are also not supposed to speak with the insurance company if they have legal counsel. 

All communication is supposed to go through the attorneys.  If you can not get in touch with your attorney, you should do everything to speak with him/her.  Contact the office if you can not get a response to your questions, then schedule an appointment to go in and speak with the attorney directly.

Keep in mind attorneys are busy and are often out of the office either in court, in hearings, taking depositions, defending depositions, doing legal research, etc, so do not expect to stop by the office and be seen. 

The proper way to handle this matter is to see if you can get your questions answered by the legal assistant or the paralegal.  If not, request a conference call to speak with the attorney directly.  If this does not provide you with the responses you need, then see if the attorney will meet with you in person by scheduling an office visit.

Remember you case is yours, but it is often more difficult to find a second attorney to take on a matter after it has been handled by an attorney than it is to find your first attorney.  Attorneys are different and have different philosophies on how to handle a matter.  As such, some attorneys will not take cases that have been handled by another attorney because they would handle a matter differently and that includes the filing of a lawsuit.
