I was given an impairment rating now what?  If you have been given an impairment rating, typically your doctor believes you are at MMI.  MMI stands for maximum medical improvement.  Typically this means the doctor does not believe there is anything medically speaking that can be done to improve your condition.  So then the doctor will either schedule you an FCE (functional capacity evaluation) or will look up in the AMA 5th Edition Guideline for Impairments and determined based upon your status what your impairment rating is to your injured body part or whole body. read more

We have a situation a lot of times where the employee is not happy with the medical care they are receiving from the doctor that has either been selected for them or they have selected through workers’ compensation. What is important is that you are comfortable with your medical care. If you’re not happy with your medical care, you’re not seeing any improvement and you don’t feel like you are being listened to by your doctor, you have options to change doctors. Can I sue anyone when I’ve been injured on the job.

I presume from this question they mean can I sue someone in a personal injury matter or as if it was a personal injury matter if I was injured on the job.  If you have been injured on the job you cannot sue your employer or co‑worker for causing the injury that occurred on the job.  You must file a workers’ compensation exclusive remedy rule.  However, if there’s a third party or there can be proven that there’s a third party that was negligent and that was the cause of your injury; for example if you are say, an electrician and you’re driving to a job, so you’re on the job and somebody runs a red light and wrecks into you.  Then you have what is known as a workers’ compensation claim and a third party personal injury claim which is something our office handles a lot of. read more

However, the adjuster is not giving me an answer where or if I can get medical care or the adjuster has denied my claim. I’m still in pain, I need medical care, what can I do? The first think you’ve got to do is you’ve got to reach out to a Georgia workers’ compensation attorney. The consultations are free. Workers’ compensation attorneys work on a contingency fee basis meaning they do not charge you any money up front. If you wish to retain them you will need to sign what’s called a contingency fee agreement and they will work on your case in exchange for a percentage of any recovery that they’re able to obtain at the end if they are. There are also expenses that need to be discussed with any attorney. However if you’re not getting the medical care you need you’re going to likely have to file a hearing.
