Hello.  My name is Ty Wilson.  I am a Savannah, Georgia workers’ compensation attorney practicing law in the State of Georgia and our topic for today is:

Can I sue anyone when I’ve been injured on the job.

I presume from this question they mean can I sue someone in a personal injury matter or as if it was a personal injury matter if I was injured on the job.  If you have been injured on the job you cannot sue your employer or co‑worker for causing the injury that occurred on the job.  You must file a workers’ compensation exclusive remedy rule.  However, if there’s a third party or there can be proven that there’s a third party that was negligent and that was the cause of your injury; for example if you are say, an electrician and you’re driving to a job, so you’re on the job and somebody runs a red light and wrecks into you.  Then you have what is known as a workers’ compensation claim and a third party personal injury claim which is something our office handles a lot of.

912-208-2992 www.TyWilsonLaw.com Savannah, Georgia workers’ compensation attorney Ty Wilson discusses what an injured worker can do if the adjuster has denied the claim and they still need medical care.

Hello. My name is Ty Wilson. I am a Savannah, Georgia workers’ compensation attorney practicing law in the State of Georgia and our video topic for today is I’ve contacted the adjuster about my workers’ compensation claim. However, the adjuster is not giving me an answer where or if I can get medical care or the adjuster has denied my claim. I’m still in pain, I need medical care, what can I do? The first think you’ve got to do is you’ve got to reach out to a Georgia workers’ compensation attorney. The consultations are free. Workers’ compensation attorneys work on a contingency fee basis meaning they do not charge you any money up front. If you wish to retain them you will need to sign what’s called a contingency fee agreement and they will work on your case in exchange for a percentage of any recovery that they’re able to obtain at the end if they are. There are also expenses that need to be discussed with any attorney. However if you’re not getting the medical care you need you’re going to likely have to file a hearing. Going to a hearing alone against a seasoned defense attorney is never recommended. Call our office today.

I was injured on the job, had surgery and now have a permanent impairment.  My doctor has released me to sedentary duty and my employer does not have this type of work for me.  I have decided I want to quit and look for sedentary duty, how will this affect my workers’ compensation claim?

If you quit your current job, the one you were injured on, they can stop your weekly income benefits never to be cut on again.  If you are not able to find work, then you have made a huge financial mistake that can affect you and your family.  A better solution is to speak with a Georgia workers’ compensation attorney to see if there are better options for you.  Typically there are, your case is at a critical point from what you have told me, so do you and your family a favor and reach out to a Georgia workers’ compensation attorney today.  The consultations are free and you will have a better understanding of what direction you should go and if you need a workers’ compensation attorney or not.

Our video topic for today is I’m on a trial calendar; it’s been already 2 years since the date of the crash, how much longer is my claim going to take or my case in this point?  Well, the short answer is if you’re on a trial calendar it shouldn’t take too much longer, but some of these cases can extend into several years and that’s something that when you file a lawsuit you need to be aware of.  It’s not something that will typically settle quickly unless you have a lot of facts in your favor.

Hello.  My name is Ty Wilson.  I’m a Georgia personal injury attorney practicing law in the State of Georgia and our video topic for today is how long does the adjuster have before they have to settle a claim with anyone who’s injured in a car wreck?

Well the short answer is, there is no time limit on them and you must impose a time limit on them.  As an attorney we have ways of placing deadlines, that’s why it’s always recommended you reach out to a Savannah personal injury attorney.
There are cases where sometimes the insurance company may not attempt to settle your injury claim and if that’s the case you have certain deadlines in which you have to file certain documents to protect yourself from losing the value of that claim completely and not being allowed to bring that claim forward in the future, it’s called a statute of limitations.
Those vary from case to case; the typical statute of limitation in Georgia is 2 years; however that can be tolled under certain circumstances, THEY CAN ALSO BE SHORTER IN CERTAIN INSTANCES so you need to reach out to a Georgia personal injury attorney immediately and find out.
What you don’t want to do is hand off your claim with less than 3 months, maybe less than 6 months in some cases before the statute of limitations has run and try to find an attorney.  A lot of attorneys are busy; we don’t have time to drop everything for your particular case.
Therefore we always recommend that you contact attorneys early so that they can gather and lock down the evidence that is needed for your claim.  We hope that you found this information helpful.  We hope that you’ll come check out our other videos and if you have any questions please feel free to give us a call.  Thank you.
