Gwinnett workers' comp lawyer | Am I entitled to benefits if I'm' taken completetly out of work?

A: Yes. You are entitled to benefits if you are taken completely off of work.

If an approved doctor takes you off of work, you are entitled to weekly benefit checks if you meet certain criteria. Keep in mind that you can only receive benefits if you are taken off of work for seven days or more, and have worked for at least 13 weeks prior to your injury.

The rate of your benefits is determined by taking the average of the 13 weeks of pay you received prior to your injury to determine your average weekly wage. Your comp rate is determined by calculating two-thirds of your average weekly wage. You then receive benefits at this rate, as long as it does not exceed $500. The maximum comp rate you can receive per week is $500.

Although you are not initially compensated for those first seven days you are off work, if you are taken off of work for at least 21 consecutive days, you will eventually be paid for the first seven days you missed.

  • Mr. Wilson is truly a very good person who cares about people. I understand he selected this career but I do know he makes many sacrifices to help he’s clients. I am very grateful to have had him as my attorney and if I ever have to use one again (hopefully not) it will be Mr. Wilson.
  • He worked with me. He told me everything. He called me. He gave me all the information.
  • He will be my family lawyer from now until the end because I can trust him.
  • He's just a great guy.
  • He always calls you right back and even if it's on the weekend - he's going to call you back.
  • Ty is a caring personal injury lawyer . . .
