What are 3 Reasons Your Georgia Workers Compensation Claim May Be Denied?

1. Not Providing Your Employer Notice of Your Injury

When you are injured on the job you are required to provide notice to your employer. This is the most important thing in initiating a Georgia workers compensation claim. If you employer does not know you were injured you will have no rights to receive medical treatment under workers compensation.

You should provide written notice of your injury and should deliver it up the chain of command if your supervisor or boss is ignoring you.

2. Not Requesting Medical Care

If you are injured on the job, you should seek medical attention to rule out a serious injury. If you decide not to seek medical care for the injury, you are also deciding not to pursue a claim.

A good rule of thumb is to request an examination by a doctor if your pain does not subside after a couple of days. Typically, the employer will have what is called a posted panel of physicians or a list of doctors. If you cannot find this list you should ask your employer. If they say they do not have one, then you should go to your own medical doctor.

3. Injured Not Doing Your Job

In Georgia, you may not be entitled to workers compensation benefits if you are not injured doing what you were hired to do, or not "injured in the course and scope of your employment." This means if you were hired to separate widgets and you hurt yourself lifting a tub of cleaner then you may not be working in the course and scope of your employment.

Other examples include horseplay or being under the influence of drugs or alcohol at the time of the injury, which can also have a serious effect on your Georgia workers compensation claim.
