Under Georgia law, food manufacturers can be held liable for tainted food regardless of their negligence in making it, but the same isn't true of those who merely sell, distribute, prepare, package or market a manufacturer's food.

Aside from product liability, those injured by poisoned food can recover damages under other areas of law, including the so-called "implied warranties" that exist between businesses and their customers, a Georgia law that allows people injured by "unwholesome provisions" to sue for damages, and another law that makes it a crime to sell adulterated or misbranded food.
