Food Safety
People who hire personal injury lawyers have been hurt by everything from negligent drivers to faulty machinery. Sometimes, they've been injured by a thing they depend on to live: food.
Foodborne illness, also known as food poisoning, claims about 5,000 lives a year in the United States and sends hundreds of thousands of people to the hospital. Most cases of food poisoning are caused by improper preparation, handling or storage of food. Salmonella is the deadliest foodborne illness, followed by other viral and bacterial infection agents.
Food Poisoning and the LawIn Georgia, as elsewhere, contaminated food cases are dealt with under an area of law known as product liability. This is the same area of law that covers faulty elevators, machinery, medical devices and other products.
The person who became sick must prove the illness was caused by the food. Beyond that, probably the most important question for someone who's suffered food poisoning is where the food came from. Under Georgia law, food manufacturers can be held liable for tainted food regardless of their negligence in making it, but the same isn't true of those who merely sell, distribute, prepare, package or market a manufacturer's food.
Aside from product liability, those injured by poisoned food can recover damages under other areas of law, including the so-called "implied warranties" that exist between businesses and their customers, a Georgia law that allows people injured by "unwholesome provisions" to sue for damages, and another law that makes it a crime to sell adulterated or misbranded food.
